Charging membership terms and conditions

BY SIGNING UP FOR MEMBERSHIP YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS DO NOT SIGN UP FOR MEMBERSHIP.

1. Who we are and what these terms do

The term ‘GRIDSERVE’, ‘our’, ‘us’ or ‘we’ refers to the GRIDSERVE group of companies which includes the owner of this app, GRIDSERVE UK OMM Limited, a company incorporated and registered in England and Wales with company number 11057010 whose registered office is at Units 9 & 10 Westerngate, Hillmead Industrial Estate, Swindon, SN5 5WN. The term ‘you’, or ‘your’ refers to the individual signing up for GRIDSERVE charging membership (“Membership”).

These terms sets out the specific terms which apply to Membership.

Please note that these terms are specific to Membership and that by using the GRIDSERVE mobile application software (“App”) to charge your vehicle you agree to use the App in accordance with App terms and conditions and use the chargers in accordance with Charging Facility terms and conditions.

2. Your privacy

These terms along with our Privacy Notice govern GRIDSERVE’s relationship with you in relation to Membership. It is important that you read these terms and our Privacy Notice so that you are fully aware of the data we collect when you sign up for Membership, how and why we use any personal data we collect, and the rights you have relating to that personal data.

3. What does it mean to be a member

Membership gives you 25% discount off the standard contactless price when charging your vehicle using the App at GRIDSERVE public charging stations on the GRIDSERVE Electric Highway available in the Apple App Store and Google Play Store

The 25% discount only applies for the first 208kWh per month. Any charging sessions in a calendar month after such threshold is reached will be charged at the standard rate applicable to the payment method used.

4. How much does Membership cost and how do I pay

Membership costs £7.99 per calendar month (“Membership Fee”).

The Membership Fee will be charged automatically each month via Stripe using the payment method provided at the time of sign-up. The date of each monthly charge will correspond to the date on which you first subscribed (or the nearest equivalent date in subsequent months, where applicable). You can see the date of your next payment in the account area. If the monthly Stripe payment fails for any reason then your membership will be suspended until payment is made.

5. How to sign up for Membership

You can sign up for Membership via the App by selecting the ‘Find Out More’ button on the home page, which will direct you to the Membership page where you can subscribe. and providing your payment information through the secure Stripe checkout to complete your subscription.

Once you have provided the above details and clicked subscribe, your Membership will be active. The discounted rate will apply immediately.

Your Membership will remain active and we will collect your Membership Fee on a monthly basis until you or we cancel your Membership. Please see the cancellation terms in clauses 6 and 7 below.

6. How to cancel your Membership

You may cancel your Membership at any time by giving one month’s notice. To cancel select ‘End membership’ in the membership area in the App.

7. When we may cancel your membership

GRIDSERVE may cancel your Membership where payment for charging sessions fail on more than one occasion. Once all outstanding payments have been made you may re register for Membership.

8. Changes to these terms

We may need to change these terms to reflect changes in law or best practice or to deal with additional features which we introduce. We will give you notice of any significant change. Please ensure you read the new terms. If you do not accept the new terms you may cancel your Membership ( see clause 6).

9. Our liability

Our liability is excluded to the maximum extent allowed under the laws of England and Wales.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors or for fraud or fraudulent misrepresentation.

We are not liable for business losses. Membership is for individual consumers only.

We are not responsible for events outside our control. If we are unable to continue providing Membership due to an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the impact on you. We will refund your Membership Fee for any month where you have been unable to receive the discounted rate.

We are not responsible for any loss or damage that was not foreseeable or any loss or damage not caused by our breach or negligence.

10. Even if we delay in enforcing these terms, we can still enforce them later

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaching the terms, that will not mean that you do not have to do those things and it will not prevent us from taking steps against you at a later date.

11. If a court finds part of these terms illegal, the rest will continue in force

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

12. No rights for third parties

This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

13. Transferring rights under these terms to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the terms.

You may only transfer your rights or your obligations under these terms to another person if we agree in writing.

14. Which laws apply to this agreement

These terms are governed by English law and you can bring legal proceedings in the English courts. The courts of England and Wales will have exclusive jurisdiction.
